New Texas SMS Law Could Impact Your Campaigns — SalesEdge.io Adds "Texas Mode" Compliance Tools
Starting September 1, 2025, a new Texas law (Senate Bill 140) will expand telemarketing regulations to include text messages. If you currently send marketing SMS to people in Texas—or if you're based in Texas—these updates may apply to your business.
This means: You may be required to register with the Texas Secretary of State, submit a $10,000 security bond or letter of credit, and follow specific rules around when and how you send texts. There are increased penalties for violations, along with a greater risk of private lawsuits.
How SalesEdge.io Helps You Stay Compliant
To help you navigate these changes, we've released a new feature called “Texas Mode.” This built-in safeguard helps you stay in compliance by regulating text message timing, verifying consent, and ensuring your campaigns meet key legal criteria.
What You Should Do
Check your audience. Are you sending SMS to Texas residents or operating from Texas?
Segment your list carefully. If you don’t plan to register, consider excluding Texas phone numbers—though this won’t protect you if your business is based in Texas.
Ensure proper consent. Only send messages to contacts who have clearly opted in to receive them.
Turn on “Texas Mode.” This feature adds necessary guardrails like enforceable time windows (8am–9pm), checking for consent, and confirming Do-Not-Disturb status.
Consult your legal advisor. This update offers educational guidance only, and you should speak to an attorney for specific recommendations.
Helpful Resources
Important: These laws apply to businesses that either send marketing texts to Texas phone numbers or operate out of Texas—regardless of where your contacts are located.
For existing SalesEdge.io users: This update is already live in your account.
